Terms of Service for Lumière Makeup Atelier

1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the services, bookings, consultations, website, communications, and related offerings provided by Lumière Makeup Atelier (“Lumière Makeup Atelier,” “we,” “us,” or “our”), a makeup-studio located at 2450 Yonge Street, Toronto, ON M4P 2H5, Canada.
By booking an appointment, purchasing a service, attending a lesson, using our website, or otherwise engaging with Lumière Makeup Atelier, you agree to be bound by these Terms. If you do not agree, you must not use our services.
These Terms are intended to be interpreted in accordance with the laws of Canada and the applicable laws of the Province of Ontario, including consumer protection, privacy, and contract laws, as applicable.
2. Scope of Services
Lumière Makeup Atelier provides professional makeup and related services, which may include, without limitation:
- Bridal makeup
- Special event makeup
- Photoshoot makeup
- Editorial and fashion makeup
- Makeup lessons and one-on-one tutorials
- Airbrush makeup application
Service descriptions, pricing, duration, availability, and any add-ons may be provided on our website, by email, by phone, or in person and may be updated from time to time. We reserve the right to refuse service, reschedule appointments, or decline requests that are unsafe, unlawful, abusive, or otherwise inappropriate.
Any recommendations regarding products, skin preparation, aftercare, or makeup application are provided for general informational purposes only and do not constitute medical advice, dermatological advice, or a guarantee of results.
3. User Obligations and Responsibilities
By booking or receiving services from Lumière Makeup Atelier, you agree to:
- Provide accurate, current, and complete information when booking or communicating with us;
- Disclose any known allergies, sensitivities, skin conditions, injuries, infections, or other relevant medical or cosmetic concerns before the appointment;
- Follow any pre-appointment instructions, including skin preparation, timing, and arrival requirements;
- Arrive on time for scheduled appointments and allow sufficient time for the service;
- Maintain respectful conduct toward our staff, contractors, and other clients;
- Ensure that minors are accompanied by a parent or legal guardian where required;
- Use any products, tools, or techniques demonstrated during lessons responsibly and in accordance with provided guidance.
You acknowledge that failure to disclose allergies, sensitivities, or relevant health information may increase the risk of adverse reactions. You are responsible for consulting a qualified medical professional if you have concerns about product suitability or skin safety.
We may refuse or discontinue service if, in our reasonable judgment, your conduct, condition, or circumstances create a safety risk, health concern, or disruption to operations.
4. Payment Terms and Conditions
All fees, deposits, taxes, gratuities, travel charges, and applicable surcharges will be disclosed at the time of booking or in a written quote. Unless otherwise stated, all prices are in Canadian dollars (CAD).
- A non-refundable deposit or booking fee may be required to secure an appointment.
- The remaining balance, if any, is due at or before the time of service unless otherwise agreed in writing.
- We may require advance payment for bridal bookings, group bookings, lessons, or special events.
- Accepted payment methods may include credit card, debit card, e-transfer, cash, or other methods communicated by us.
- You are responsible for any fees charged by your financial institution or payment provider.
If a payment is declined, reversed, disputed, or charged back without valid cause, we reserve the right to suspend services, cancel future bookings, and recover any associated administrative, collection, or legal costs to the extent permitted by law.
Quotes are based on the information provided at the time of booking. Changes to scope, timing, location, number of clients, or requested services may result in additional charges.
5. Cancellation and Refund Policy
We understand that plans may change. Cancellations and rescheduling requests should be made as early as possible and in accordance with the booking terms communicated at the time of reservation.
- Deposits and booking fees are generally non-refundable unless otherwise required by applicable law or expressly stated in writing.
- Late cancellations, no-shows, and same-day cancellations may be charged in full or partially forfeited, depending on the service and notice provided.
- Rescheduling may be permitted subject to availability and may require advance notice.
- For bridal, group, or event bookings, special cancellation terms may apply and will be communicated in the booking agreement or invoice.
- If we must cancel due to illness, emergency, unsafe conditions, or force majeure, we will make reasonable efforts to reschedule or provide a refund of amounts paid for services not rendered, subject to applicable law and the specific circumstances.
Refunds, where applicable, are limited to the amount paid for the affected service and do not include indirect losses, travel expenses, accommodation costs, or other consequential damages, except where required by law.
6. Liability Limitations
To the fullest extent permitted by applicable law, Lumière Makeup Atelier, including its owners, employees, contractors, and agents, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the use of our services.
Without limiting the foregoing, we are not responsible for:
- Adverse skin reactions, allergic reactions, or sensitivities not disclosed by you;
- Damage caused by failure to follow aftercare instructions or product guidance;
- Results affected by weather, humidity, perspiration, tears, touch, rubbing, or extended wear;
- Delays or missed appointments caused by traffic, weather, third parties, venue restrictions, or circumstances beyond our control;
- Losses arising from inaccurate information provided by you;
- Any outcomes that differ from subjective expectations, including color perception, finish, or longevity.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or any other liability that cannot lawfully be limited or excluded under Canadian or Ontario law.
If we are found liable for any claim arising from our services, our total aggregate liability shall be limited to the amount paid by you for the specific service giving rise to the claim, to the extent permitted by law.
7. Intellectual Property Rights
All content created, displayed, or provided by Lumière Makeup Atelier, including but not limited to text, images, logos, branding, service descriptions, training materials, lesson content, photographs, videos, and website materials, is owned by or licensed to Lumière Makeup Atelier and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, transmit, create derivative works from, or commercially exploit any of our content without our prior written consent, except as permitted by law.
Unless otherwise agreed in writing, any makeup techniques, lesson materials, or educational content shared during tutorials remain the intellectual property of Lumière Makeup Atelier and are provided for your personal, non-commercial use only.
With respect to photographs or videos taken by us during services, we may request your consent to use such materials for portfolio, marketing, social media, or promotional purposes. Where required by law, we will obtain appropriate consent before using identifiable images of you.
8. Data Protection and Privacy
Lumière Makeup Atelier collects, uses, stores, and discloses personal information only as necessary to provide services, manage bookings, process payments, communicate with you, comply with legal obligations, and improve our operations, in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws.
Personal information may include your name, contact details, appointment history, payment-related information, preferences, skin concerns, allergy disclosures, and communications with us.
- We use reasonable safeguards to protect personal information against unauthorized access, loss, or misuse.
- We may share personal information with service providers that assist us in operating our business, such as payment processors, booking platforms, or IT providers, subject to appropriate confidentiality and security measures.
- We will retain personal information only as long as reasonably necessary for the purposes described above or as required by law.
- You may have rights to access, correct, or request deletion of certain personal information, subject to legal and contractual limitations.

9. Force Majeure
Lumière Makeup Atelier shall not be liable for any delay, failure to perform, or cancellation caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, power outages, labour disputes, illness, public health emergencies, government restrictions, transportation disruptions, venue closures, or equipment failure.
In such circumstances, we may reschedule the service, substitute personnel where appropriate, or cancel the appointment. Any refund or credit will be handled in a manner consistent with applicable law and the specific circumstances of the booking.
10. Changes to Terms
We may update or modify these Terms from time to time to reflect changes in our business practices, legal requirements, or operational needs. The revised Terms will be effective when posted on our website or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should discontinue use of our services and refrain from making new bookings.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, our services, or your use of our website shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to any mandatory consumer protection rights or other non-waivable legal rights, you agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising from or related to these Terms or our services.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Any unenforceable provision shall be interpreted, where possible, to best reflect the original intent of the parties and to remain consistent with applicable law.
